1. Acceptance of Terms

Welcome to Net Utils (the “Service”), operated by Net Utils (“we”, “us”, “our”). These Terms of Use (“Terms”) govern your access to and use of our website, network diagnostic tools, and related services.

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Please read these Terms carefully. They contain important information about your rights, remedies, and responsibilities.

2. Description of the Service

Net Utils provides a suite of online network diagnostic tools that help analyze, monitor, and troubleshoot infrastructure. Tools include, without limitation, IP lookup, DNS checks, DNS propagation, WHOIS, SSL checks, email health analysis, HTTP/CURL tests, ping, MTR, traceroute, reverse DNS, speed tests, IP blacklist checks, and port scanning (collectively, the “Tools”). Results are provided for informational purposes only.

3. Accounts, if applicable

Most Tools currently do not require registration. Some protected service or administrative functions may require credentials, and future features may require an account. If credentials are issued to you, you are responsible for keeping them confidential and for all activity under them. You agree to notify us immediately about unauthorized use.

4. Acceptable Use and Conduct

You agree to use the Service lawfully and in accordance with these Terms. You may:

• use the Tools for legitimate diagnostics and troubleshooting;
• run tests only on networks and systems for which you have explicit permission or operational responsibility;
• use obtained information within legal and ethical boundaries.

5. Prohibited Use

Use of the Service is strictly prohibited where it:

• violates applicable national or international laws;
• aims to harm, exploit, threaten, or harass others;
• attempts to gain unauthorized access to, interfere with, damage, or disrupt any part of the Service, its servers, or connected systems;
• scans, probes, or tests any network or system without explicit prior authorization from the owner;
• uses the Tools for malicious activity, including DoS attacks, spam, malware distribution, credential abuse, or unauthorized security testing;
• overloads, disables, scrapes, bypasses rate limits, or degrades the Service;
• impersonates Net Utils, its operators, another user, or any other person or entity;
• resells or commercially exploits the Service or Tools without our written permission.

Violations may result in immediate suspension or termination of access and may create civil or criminal liability.

6. Intellectual Property Rights

The Service and its content, features, functionality, software, text, layout, visual design, and interfaces are owned by Net Utils, its licensors, or other rights holders and are protected by copyright, trademark, know-how, and other laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit Service materials except as allowed by normal Service functionality or with our permission.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Net Utils and persons associated with Net Utils do not guarantee the completeness, security, reliability, quality, accuracy, or availability of the Service. We do not guarantee that results, content, or services obtained through the Service will be accurate, reliable, error-free, uninterrupted, free from harmful components, or suitable for your needs.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NET UTILS, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS WILL NOT BE LIABLE UNDER ANY THEORY FOR DAMAGES ARISING OUT OF OR RELATED TO USE OF, OR INABILITY TO USE, THE SERVICE, LINKED SITES, CONTENT, OR SERVICES, INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF REVENUE, PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, WHETHER FORESEEABLE OR NOT.

This does not limit liability that cannot be excluded under applicable law. You are responsible for any harm or losses caused by using the Tools contrary to these Terms or the law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Net Utils, its affiliates, licensors, service providers, and their respective officers, directors, employees, contractors, agents, suppliers, successors, and assigns from claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees, including reasonable attorneys’ fees, arising out of your violation of these Terms or your use of the Service outside what is expressly permitted.

10. Termination of Access

We may terminate or suspend your access to all or part of the Service immediately, without prior notice or liability, for any reason, including violation of these Terms. After termination, your right to use the Service ends. Provisions that by their nature should survive termination will continue to apply, including ownership rights, disclaimers, indemnification, and limitations of liability.

11. Governing Law and Disputes

These Terms and any disputes or claims arising from or related to them are governed by the applicable laws of the jurisdiction where the service operator is established, without regard to conflict-of-law rules.

Any claim, proceeding, or dispute related to these Terms or the Service should be brought before courts of competent jurisdiction where the service operator is established, unless mandatory consumer protection laws in your location provide otherwise.

12. Changes to Terms

We may change or replace these Terms at any time. For material changes, we will make reasonable efforts to provide notice at least 30 days before the new terms take effect. By continuing to use the Service after changes become effective, you agree to the updated Terms. The update date is shown at the top of this page.

13. Miscellaneous

Entire agreement: these Terms and the Privacy Policy form the entire agreement between you and Net Utils regarding the Service and replace prior written or oral understandings.

Waiver and severability: failure to enforce a provision is not a waiver. If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect.

Assignment: you may not assign rights or obligations under these Terms without our written consent. We may assign our rights and obligations in whole or in part where permitted by law.
